In Italia, negli ultimi anni, la tematica della responsabilità professionale medica ha assunto un’importanza crescente nella politica sanitaria, con importanti risvolti in ambito di economia sanitaria.
A livello sia ministeriale che regionale sono in atto iniziative per garantire la sicurezza dei pazienti ed impegnare in questo senso la responsabilità delle aziende sanitarie.
Gli Autori analizzano i diversi profili di responsabilità del medico, con particolare attenzione all’ambito penale e civile ed ai risvolti del “risk managment”.
Summary
In Italy, over the last two decades, medical professional liability has become a prominent issue in healthcare policy and a major concern for healthcare economics.
The Italian physician has, in the course of his activities, civil and criminal liability. This means that he will respond, in every case of alleged negligence or imprudence in civil courts for the damage possibly caused to the patient, and probably in criminal courts for negligent personal injuries.
The article wil analyze the main aspects of medical liability and of risk management systems in the Health Care structures.
The final aim is a better patient’s care, a decrease in missed diagnosis and acuity and decreased lenght of stay, and, consequently, a better risk management, decreased malpractice liability and cost effectiveness.
